Personal data may be transferred to a recipient in the USA if special guarantees are provided for an adequate level of data protection. Such guarantees can be provided above all in the conclusion of so-called EU standard contractual clausesthe existence of binding internal data protection regulations (binding corporate rules) at the recipient company or in a decision of the European Commissionin which the recipient's compliance with an appropriate data protection standard is confirmed.
